Soon, you will have to resume your social elections procedure by posting your new election date, any adapted time schedule and your adapted electoral calendar at the latest on your new day X+29 (which falls in the period between 16 and 29 September 2020).

Because of the COVID-19 pandemic, the social elections procedures have been suspended in about 7,000 companies since the initial day X+36. Soon, the election procedures will formally resume as from the new day X+36, which falls in the period from 23 September until 6 October 2020. You will, however, have to post your new election date, any adapted time schedule and your adapted electoral calendar at the latest on your new day X+29 (which falls in the period from 16 until 29 September 2020).

New election date?

Your new day Y falls in the period from 16 until 29 November 2020. The new date is determined in correlation with the originally set election date. If the elections were initially to take place, for instance, on Monday 11 May 2020, they will now have to take place on Monday 16 November 2020. For companies whose original day Y fell outside the period from 11 until 24 May 2020 (e.g., because the procedure has been delayed), there is a different rule.

The WC or the CPPW may decide to depart from this default date by choosing another date within the statutory period. If no WC or CPPW exists in the company today, the employer may unilaterally determine the other election date.

New time schedule?

The time schedule communicated on the original day X in February remains applicable. The WC or the CPPW or, in their absence, the employer, may adapt this time schedule. The number of hours originally planned may however not be reduced. In view of the corona situation, you could, for instance, provide for longer opening hours of the polling station in order to spread more the number of voters physically. If you will not or cannot extend the time schedule, you could also consider organising a vote by letter or electronically. To this end, you must conclude a written agreement with the trade union organisations that have put forward candidates at the latest on your new day X+56 (which falls in the period from 13 until 26 October 2020).

To do: posting on your new day X+29

The new election date, any adapted time schedule and the new electoral calendar should be posted at the latest on your new day X+29 in the same places as the announcement on your original day X. The posting on paper may be replaced by electronic posting (e.g., via the intranet) if all employees have access to it during normal working hours. You also need to upload this announcement on the web application of the FPS Employment. If you only have a trade union delegation, you must also provide it with a copy.

At the latest on your new day X+29 (which falls in the period from 16 until 29 September 2020), you must proceed with the posting of your new election date, any adapted time schedule and your adapted electoral calendar. Download your calendar here.
