New salary thresholds for white-collar workers
As it does every year, the Federal Public Service Employment has changed the remuneration thresholds to be taken into account for applying certain provisions of employment contracts of white-collar workers.
From 1 January 2013 the following amounts will be taken into account:
Basic amounts |
Amounts 2012 |
Amounts applicable as of 1 January 2013 |
16.100 EUR |
31.467 EUR |
32.254 EUR |
19.300 EUR |
37.721 EUR |
38.665 EUR |
32.200 EUR |
62.934 EUR |
64.508 EUR |
Those amounts serve as the basis for calculating the duration of the trial period, the notice period, the counter notice and determining the right of a white-collar worker to paid leave from their work to find a new job.
Besides those provisions, those amounts will also allow employers to ensure the validity of a non-compete clause and an arbitration clause.
These amounts should also be used when applying the new notice periods for employees whose employment started on or after 1 January 2012. The new 'fixed' notice periods for employees are thus applicable to the so-called 'higher' employees with a gross annual salary of more than 32.254 EUR who started working on or after 1 January 2012.
