The Federal Public Service Employment has changed the remuneration thresholds to be taken into account for applying certain legal provisions of employment contracts of white-collar employees.

As of 1 January 2014, only two amounts will apply:

Basic amounts

Amounts applicable for 2013

Amounts applicable as of 1 January 2014

16.100 EUR

32.254 EUR

32.886 EUR

32.200 EUR

64.508 EUR

65.771 EUR

This adjustment is a result of the introduction of the new laws on dismissals, harmonising the status of blue- and white-collar workers with regards to notice periods and the first day of sick leave (see our newsflash of 30 October 2013).

This means essentially that the salary thresholds applicable for employment contracts in 2014 will only be relevant for the validity of the non-competition clause, the arbitration clause and the education clause.

> Action point

As of 1 January 2014, employers have to use new salary thresholds to determine if the non-competition clause, the arbitration clause and the education clause are valid.
