National Labour Council proposes dates

On 2 March 2011, the National Labour Council has an advice given in which it proposes that social elections take place from 7 May to 20 May 2012 included.

Those data have to be confirmed by an Act settling the organization of the social elections.

If the above mentioned data are effectively retained, the first day of the pre-electoral procedure (known as Day X-60) will take place between the 9 and the 22 December 2011, in function of the data at which the social elections will be organized within the enterprise.

For this data at the latest, the employer has to inform, by way of a written, the works council and the committee for prevention and protection at work, or, if not, the union delegation:

1° on the nature, the domains and the autonomy's and dependence's degree of the seat towards the legal entity. If a body was already instituted, the information only concerns the modifications intervened in the structure of the enterprise and the new autonomy's and dependence's criterions of the seat towards the legal entity;

2° on the staff's number per category (blue collar workers, white collar workers included the executives and the managerial staff, young workers), taking into account the staff's number occupied in the enterprise at that time;

3° on the managerial staff's functions, by pointing out their denomination and their content and the list of people who exercise those functions;

4° on the executive's functions and the list of people who exercise those functions (if a works council has to be instituted and if the enterprise counts at least 30 white collar workers at the day X-60);

5° on the posting's data of the advice announcing the elections and on the data envisaged for the elections.

Furthermore, on basis of the data proposed by the National Labour Council for the holding of the social elections, the beginning of the special protection's period (known as "occult") against dismissal will be situated between the 8 and the 21 February 2012, still in function of the data at which the social elections will be organized within the enterprise.
