On Thursday 30 April 2015, the Act establishing the maximum margin for the evolution of remuneration costs for 2015 and 2016 was published in the Belgian Official Gazette and entered into force.

 

In accordance with the so-called "group of ten agreement", this act provides that the maximum remuneration margin is set at:

  • 0% for 2015;
  • 0.5% of the gross remuneration (all charges included), amount to be increased by 0.3% of the net remuneration (without additional costs for the employer) for 2016.

In accordance with the applicable provisions, it is forbidden to conclude agreements (of any kind) which exceed the above-mentioned margin.

Even if the law does not explicitly specify this, the indexations are, in principle, not taken into account as they are blocked for the moment due to the index jump. Also, the scale increases remain allowed.

The new act entered into force on 30 April 2015. To this day we are not aware of any other modifications on this topic, even though the government had announced a reinforcement of the applicable sanctions as part of the agreement. We will keep you informed about further developments.
