The draft bill concerning the introduction of harmonised dismissal rules was introduced in the House of Representatives on 21 November 2013.

After the approval of the draft bill on harmonised dismissal rules by the Council of Ministers in its second reading on 14 November 2013, the bill was introduced in the House of Representatives one week later. The House of Representatives is expected to adopt the formal text in the next few weeks. Here is a link to the bill's text.

The bill seeks to transform into legislation the compromise reached by the social partners this summer (see Newsletter of 11/07/2013).

The intention is to modify the law of 3 July 1978 concerning employment contracts, with regard to its stipulations on notice periods and the first unpaid day of sick leave.

The Council of Ministers took note of the advice issued by the Supreme Administrative Court, but largely ignored the Court's objections.

Action Point

In the new year we will be organising a series of seminars on this bill, which should have entered into force by then. You will receive more information in this regard shortly.
