All companies wanting to introduce the regime of temporary unemployment due to the coronavirus can resort again to the flexible regime of temporary unemployment due to corona force majeure

The government has decided, in light of the new lockdown measures, that all companies affected by the crisis can resort again to the corona unemployment regime.

As a result, there are no longer any conditions for applying this regime of temporary unemployment. The employer thus no longer has to prove that there were at least 20% days of temporary unemployment in the second quarter of 2020 or that it belongs to an exceptionally hard-hit sector.

As before, this unemployment regime is identical for blue-collar and white-collar workers. All formalities related to the corona unemployment regime remain the same (information to be sent to the works council or the trade union delegation, individual notification to the employees and an ASR declaration scenario 5 to be submitted at the end of the month).

Companies that benefited in the meantime from the regime of economic unemployment can now shift back to the corona unemployment regime.

This flexible regime of unemployment will in theory be accepted for all employers until 31 March 2021.

 If your company wishes to use the corona temporary unemployment regime, make sure you follow the formalities correctly: send information to the works council or the trade union delegation, individual notification to the employees and submit an ASR declaration scenario 5 at the end of the month.
