Individual employment law
We deal with all aspects of employment law: employment agreements, individual dismissals, work rules, working hours, safety at work, temporary work, cross-border employment and international secondments, wages and related aspects. The firm has a substantial litigation practice in these areas. The Claeys formula, which is widely used in Belgium to calculate notice periods, was developed by Thierry Claeys, a partner of our firm.
Collective labour law
We advise on all rules governing the employee representative bodies within the company including social elections. We also offer advice and assistance in negotiating and drafting company-level collective bargaining agreements. We were pioneers in introducing claims in the event of strikes and industrial disputes.
We assist our clients with collective negotiations in relation to company restructuring and transfers of undertakings as a result of mergers and acquisitions, etc.
European labour law
We also monitor the activities of the European institutions and the decisions of the European Court of Justice. We have close ties with the European Commission and also work to safeguard the interests of our clients in dealings with the European institutions.
Criminal aspects of labour law
Claeys & Engels is active in criminal aspects of employment law and administrative fines that may be imposed for labour law offences.
